En este texto presentamos el modelo que se ha diseñado para implementar la evaluación por colegas pares en la Universidad del Rosario. Explicamos los principios que lo guían y las etapas y procedimientos para realizar esta evaluación; además, exponemos algunos aprendizajes que ha dejado su implementación en dos facultades en los últimos años, y presentamos algunos retos y desarrollos que enfrenta el modelo a futuro.

Este proyecto responde a un momento histórico de gran importancia, que por supuesto no pudo ser más oportuno. Colombia celebra en el año 2006 los quince años de la promulgación de su Constitución Política, y los cambios de trascendentales surgidos a partir de su aplicación has sido prolíficos, Particularmente, el tema ambiental ha sobresalido dentro de las grandes transformaciones del país, y por ello no en vano hoy se afirma que tenemos una verdades Constitución ecológica. De igual forma, la Facultad (...) de Jurisprudencia de la Universidad del Rosario conmemora los die años de la creación de la especialización en Derecho Ambiental, y tal coincidencia histórica fue una motivación adicional para proponer la realización de un análisis de la evolución normativa surtida para proponer la realización de un análisis de la evolución normativa surtida en este decenio, una evaluación de la gestión ambiental colombiana y de sus distintos impactos en una sociedad que cuenta hoy en día con herramientas constitucionales legales para la defensa de sus derechos e interese colectivos. La Universidad del Rosario ha sido parte de esta evolución, desarrollando un rol activo con el cual se han abierto espacios de discusión y de proposición de alternativas, herramientas y experiencias en pro de la protección integral de la diversidad étnica, cultural y natural de la Nación colombiana. Así, se ha constituido como facilitadora del proceso de la formación de los nuevos actores y ha tenido gran posicionamiento en procesos de participación y de estructuración de proyectos institucionales ambientales. Se comparten experiencias áulicas de la Universidad Nacional de Rosario, Argenti- na. Su objetivo es crear un instrumento para evaluar la riqueza creativa en diseño mecánico, con un método exploratorio y propositivo de validación de instrumentos y pruebas piloto sobre 156 estudiantes. Resultaron de imaginar objetos diversos, compatibles con una vista dada, y definir cinco niveles de riqueza según la canti- dad, diversidad y calidad de respuestas comparadas contra un patrón de soluciones creado por expertos. Se ensayaron cambios de (...) duración, complejidad de estímulos y presencia de soluciones preexistentes que confirmaron su potencial para investigar la creatividad en este dominio específico. This chapter surveys essentialist and anti-essentialist theories of sex and gender. It does so by engaging three approaches to sex and gender: externalism, internalism, and contextualism. The chapter also draws attention to two key debates about sex and gender in the feminist literature: the debate about the sex/gender distinction (the distinction debate) and the debate about whether sex and gender have essences (the essentialism/anti-essentialism debate). In addition, it describes three problems that theories of sex and gender tend to face: the (...) Inclusion Problem, the Definition Problem, and the Exclusion Problem. Lastly, the chapter highlights why the division between essentialist and anti-essentialist accounts of sex and gender is not clear. (shrink)

The 1927 Solvay conference was perhaps the most important meeting in the history of quantum theory. Contrary to popular belief, the interpretation of quantum theory was not settled at this conference, and no consensus was reached. Instead, a range of sharply conflicting views were presented and extensively discussed, including de Broglie's pilot-wave theory, Born and Heisenberg's quantum mechanics, and Schrödinger's wave mechanics. Today, there is no longer an established or dominant interpretation of quantum theory, so it is important to re-evaluate (...) the historical sources and keep the interpretation debate open. This book contains a complete translation of the original proceedings, with background essays on the three main interpretations of quantum theory presented at the conference, and an extensive analysis of the lectures and discussions in the light of current research in the foundations of quantum theory. The proceedings contain much unexpected material, including extensive discussions of de Broglie's pilot-wave theory (which de Broglie presented for a many-body system), and a theory of 'quantum mechanics' apparently lacking in wave function collapse or fundamental time evolution. This book will be of interest to graduate students and researchers in physics and in the history and philosophy of quantum theory. (shrink)

The goal of this paper was to investigate whether and how a firm that engages in different kinds of corporate social performance can create a favorable corporate reputation among its stakeholders, and as a result achieve a good financial performance. Building on stakeholder theory, we distinguish two types of reputation—reputation among public stakeholders and reputation among financial stakeholders. We argue that CSP activities affect these two reputations differently. In addition, we empirically test the relationship among different types of CSP, reputation (...) among public and financial stakeholders, and financial performance. Our results suggest that Carroll’s four types of CSP affect financial performance differently, and their effects are mediated by reputation among public and financial stakeholders. Our findings provide guidelines for managers on choosing to emphasize certain CSP aspects in their communication, depending on the specific stakeholder group they are targeting. (shrink)

Proofs are de.ned as certain sequences of questions. The method is grounded in Inferential Erotetic Logic.

This monograph details a new solution to an old problem of metaphysics. It presents an improved version of Ostrich Nominalism to solve the Problem of Universals. This innovative approach allows one to resolve the different formulations of the Problem, which represents an important meta-metaphysical achievement. In order to accomplish this ambitious task, the author appeals to the notion and logic of ontological grounding. Instead of defending Quine’s original principle of ontological commitment, he proposes the principle of grounded ontological commitment. This (...) represents an entirely new application of grounding. Some metaphysicians regard Ostrich Nominalism as a rejection of the problem rather than a proper solution to it. To counter this, the author presents solutions for each of the formulations. These include: the problem of predication, the problem of abstract reference, and the One Over Many as well as the Many Over One and the Similar but Different variants. This book will appeal to anyone interested in contemporary metaphysics. It will also serve as an ideal resource to scholars working on the history of philosophy. Many will recognize in the solution insights resembling those of traditional philosophers, especially of the Middle Ages. (shrink)

In this paper we propose an extension of Defeasible Logic to represent and compute different concepts of defeasible permission. In particular, we discuss some types of explicit permissive norms that work as exceptions to opposite obligations or encode permissive rights. Moreover, we show how strong permissions can be represented both with, and without introducing a new consequence relation for inferring conclusions from explicit permissive norms. Finally, we illustrate how a preference operator applicable to contrary-to-duty obligations can be combined with a (...) new operator representing ordered sequences of strong permissions. The logical system is studied from a computational standpoint and is shown to have linear computational complexity. (shrink)

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del (...) ordenamiento jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. The current interest in the notions of ontological dependence and metaphysical grounding is usually associated with a renewal of interest in Aristotelian metaphysics. Curiously, some authors have recently argued that the Aristotelian view of universals, according to which universals depend for their existence on their exemplifiers, is incoherent from a grounding perspective. In this paper I argue that such criticism is misleading. I shall examine their arguments and clarify the supposed incoherence.

SummaryThis article presents a transcription of three brief unpublished essays written by Richard Cobden on Spain, Russia and Venice, along with a critical introduction. These three essays were written during Cobden's European tour, between 1846–47. Excluded from Miles Taylor's edition of the European Diaries, published in 1994, they have escaped scholarly attention. In the introduction I argue that the three essays deserve further study, either by themselves or as part of the European Diaries. Going beyond an anecdotal record of Cobden's (...) activities, the essays concerning Spain, Venice, and Russia examine different economic and political issues of each context. Particularly since Cobden planned to write a theoretical work about free trade as linked to other aspects of society and politics, they can help to revise some interpretations of Cobden's liberalism where his ideas on free trade are overpowering. In this paper I generalize the new approach to nonmonotonicreasoning that was presented in [6]. This generalization results in the inconsistency-adaptive logic PRL . I give proof theory, semantics, mention interesting properties,and comment on the reconstruction and amelioration of other nonmonotoniclogics and mechanisms.

While rooted in careful study of Mead’s original writings and transcribed lectures and the historical context in which that work was carried out, the papers in this volume have brought Mead’s work to bear on contemporary issues in metaphysics, epistemology, cognitive science, and social and political philosophy.

The Problem of Universals is one of the oldest problems of metaphysics. And still, there is no agreement, neither about its nor about its. What is the most adequate formulation of the problem? And what kind of explanation does it require? My aim in this paper is to offer an overview of these two basic questions in the contemporary debate. I will present the four most important formulations (section 1), discuss their connections (section 2) and how the three most prominent (...) are related to these formulations (section 3). We will see that, despite the long history of the problem, in recent years new formulations and approaches have been proposed which may open up original perspectives on its solution. (shrink)

There have been innumerable attempts to characterize personal identity either in terms of psychological continuity or in terms of the linear and self-referential process of reproduction of one's self. I will defend the thesis according to which personal identity emerges mainly as a process of transcendence of one's own "minimal self". It is precisely by means of this critical distancing from his self, I contend, that the individual learns to see himself under a new perspective as far as to experience (...) his self as a surprise. Amazed at his own self, he lives a reawakening which leads him to a transformation of his way of living. This transcendence of the self cannot take place self-referentially but only through the force of an example provided by another person. Such act neither aims at the annihilation of the individual, nor does it contrast with self-love. It is in conlict merely with what Harry Frankfurt calls "selfindulgence". The idea of a transcendence of the self is already to be found in Plato, who fostered the overcoming of and puriication from amathia (in the sense of a "not knowing but pretending to know") and from an excessive love of oneself. Indeed, these latter would be the two grave diseases which render formless the soul of a human being, for they stand in the way of the cura sui. The same theme will reappear in Max Scheler's phenomenological reduction, which endeavours to bracket egocentrism (construed as excessive love of oneself) in order to give a form to the personal identity. Social facts require an ontological foundation because they are constitutive in human practices. Can a theory of the documentation supply us with a definitive foundation of the social practices disregarding the cognitive aspects of the cooperation? The article claims that social ontology cannot lie only on external aspects of the sociality like documents because it has also to investigate its mental and linguistic aspects.

The present paper seeks, from the political realism of Hinkelammert and the politics of the liberation of Dussel, to identify the initial limits that delineate the framework of political action. The political action framework delimits the space of empirical possibility. For it, the definition of politics is adopted as “art of the possible”, explicitly accepted by Hinkelammert and developed implicitly by Dussel. Three limits are identified that outline the framework of political action: 1) the natural environment as a condition of (...) existence of living corporality, 2) the satisfaction of physical needs as a condition to preserve living corporality, 3) intersubjective experiences as a condition to maintain the human life. Propose these limits allows to establish the bases of the utopia of the political realism of Hinkelammert and of the politics of the liberation of Dussel. (shrink)
